Asbestos Policy

 

 

 

 

1. Introduction

a. This document serves as an addendum and should be read in conjunction with our General Terms of Trade and Damage Policy. These terms have been incorporated into the quote provided to you.

b. The objective of this document is to clarify the terms of our service and your obligations and acknowledgments in the event that asbestos or perceived asbestos is discovered before, during, or after our works are performed.

 

2. Your Acknowledgments

You acknowledge that:

• We do not quote for or provide any works where asbestos or perceived asbestos is present at or near the location of the works.

​

• We agree to perform the works on the basis that neither you nor we have knowledge of asbestos or perceived asbestos being present at the works area.

​​

• Any discovery of asbestos or perceived asbestos will result in an immediate cessation of works.

​

• You will pay us for the portion of the works completed up to the cessation.

​

• We will not be held responsible for not discovering asbestos during any initial site visit or at the commencement of works.

​

• An added asbestos contingency fee of $250 plus GST will be charged to you for the additional costs incurred due to the suspension of work and management of potential asbestos-related risks.

​

• We will only return to perform the remaining works once a third-party asbestos clearance certificate is provided to us.

​

• Either you or we may cancel the remaining works should any asbestos or perceived asbestos be discovered.

​

• While we will take due care and skill in trying to identify asbestos material, should the perceived asbestos return a negative test result, you will not hold us liable, either directly or indirectly, for any consequential loss or expenses, including but not limited to loss of profit, arising from the decision to cease work.

​

• We exclude all liability for any incidents or outcomes resulting from asbestos dust that becomes airborne or present as a direct or indirect consequence of our works. This includes, but is not limited to;  any health effects, property contamination, or environmental impact caused by asbestos fibres released during our operations.

​

• We also exclude liability for any claims related to asbestos exposure, including medical costs, property decontamination, and any legal or compliance costs associated with asbestos management and remediation following such incidents.
